Terms and Conditions

Article 1 – Definitions

In these terms and conditions, the following definitions apply:

  • Cooling-off period: The period within which the consumer can exercise their right of withdrawal.
  • Consumer: The natural person who does not act in the exercise of a profession or business and enters into a distance contract with the entrepreneur.
  • Day: Calendar day.
  • Distance contract: An agreement concluded within the framework of a system organized by the entrepreneur for the remote sale of products and/or services, in which, up to and including the conclusion of the agreement, exclusively one or more techniques for remote communication are used.
  • Sustainable data carrier: Any medium that enables the consumer or entrepreneur to store information directed at them in a way that allows for future consultation and unchanged reproduction of the stored information.
  • Right of withdrawal: The option for the consumer to cancel the distance contract within the cooling-off period.
  • Entrepreneur: The natural or legal person offering products and/or services remotely to consumers.
  • Remote communication technique: A means that can be used to conclude a contract without the consumer and entrepreneur being in the same room at the same time.
  • General Terms and Conditions: These General Terms and Conditions of the entrepreneur.

Article 3 – Applicability

These general terms and conditions apply to every offer made by the entrepreneur and to every distance agreement and order between the entrepreneur and the consumer.

Before the distance agreement is concluded, the text of these terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated before the agreement is concluded that the general terms and conditions can be viewed with the entrepreneur and that they will be sent to the consumer free of charge upon request.

If the distance agreement is concluded electronically, in deviation from the previous paragraph, the text of these general terms and conditions may be provided to the consumer electronically in such a way that the consumer can easily store it on a sustainable data carrier. If this is not reasonably possible, it will be indicated before the agreement is concluded where the general terms and conditions can be consulted electronically and that they will be sent to the consumer electronically or otherwise free of charge upon request.


Article 4 – The offer

If an offer has a limited validity or is subject to certain conditions, this will be explicitly stated in the offer.
The offer is non-binding. The entrepreneur is entitled to modify and adjust the offer.

The offer contains a full and accurate description of the offered products and/or services. The description is detailed enough to allow the consumer to make a proper assessment of the offer. If the entrepreneur uses images, they will be a true representation of the offered products and/or services. Apparent mistakes or errors in the offer do not bind the entrepreneur.


Article 5 – The agreement

The agreement comes into effect, subject to the provisions in paragraph 4, at the moment the consumer accepts the offer and fulfills the conditions set.

If the consumer has accepted the offer electronically, the entrepreneur will confirm receipt of the acceptance electronically without delay. As long as the entrepreneur has not confirmed the receipt of the acceptance, the consumer can cancel the agreement.

The entrepreneur will take appropriate technical and organizational measures to secure the electronic transfer of data and ensure a secure web environment.


Article 6 – Right of withdrawal

When purchasing products, the consumer has the possibility to dissolve the agreement without giving any reason within 14 days. This cooling-off period starts the day after the consumer has received the product or a third party designated by the consumer.

During the cooling-off period, the consumer must handle the product and its packaging carefully. They will only unpack or use the product to the extent necessary to assess whether they want to keep the product. If the consumer exercises their right of withdrawal, they must return the product with all supplied accessories, and if reasonably possible, in the original state and packaging according to the instructions provided by the entrepreneur.


Article 7 – Costs in case of withdrawal

If the consumer exercises their right of withdrawal, the costs for returning the products will be at the consumer's expense.
If the consumer has made a payment, the entrepreneur will refund this amount as soon as possible, but no later than within 14 days after the withdrawal, provided the product has already been returned or evidence of the return shipment is provided.


Article 8 – Exclusion of the right of withdrawal

The entrepreneur may exclude the right of withdrawal for products as defined in paragraphs 2 and 3. The exclusion applies only if the entrepreneur has clearly stated this in the offer or, at least, before the agreement is concluded.


Article 9 – The price

The prices of the offered products and/or services will not be increased during the validity period of the offer, except for price changes due to changes in VAT rates.

Price increases within 3 months after the conclusion of the agreement are only allowed if they are the result of legal provisions or regulations.

The prices mentioned in the offer for products or services include VAT.


Article 10 – Conformity and Warranty

The entrepreneur guarantees that the products and/or services comply with the agreement, the specifications mentioned in the offer, and the reasonable requirements of quality and/or usability as of the date the agreement is concluded. If agreed, the entrepreneur also guarantees that the product is suitable for other than normal use.

The warranty provided by the entrepreneur, manufacturer, or importer does not affect the legal rights the consumer can enforce against the entrepreneur under the agreement.


Article 11 – Delivery and execution

The entrepreneur will take the utmost care in receiving and fulfilling orders for products.
The delivery address is the address provided by the consumer to the entrepreneur. The entrepreneur will execute the accepted orders promptly, but no later than 30 days, unless the consumer agrees to a longer delivery period.


Article 12 – Duration contracts: duration, termination, and extension

Termination
The consumer can cancel a contract concluded for an indefinite period, which relates to the regular delivery of products or services (including electricity), at any time with due observance of the agreed cancellation rules and a notice period of no more than one month.
A contract concluded for a definite period can be canceled at any time before the end of the agreed period with due observance of the agreed cancellation rules and a notice period of no more than one month.


Article 13 – Payment

Unless otherwise agreed, the amounts owed by the consumer must be paid within 7 working days after the cooling-off period starts.
The consumer must report any errors in the payment details provided without delay to the entrepreneur.


Article 14 – Complaints procedure

Complaints about the performance of the agreement must be fully and clearly submitted to the entrepreneur within 7 days after the consumer has discovered the defects. The entrepreneur will respond to complaints within 14 days.


Article 15 – Disputes

Dutch law applies to agreements between the entrepreneur and the consumer to which these general terms and conditions apply, even if the consumer resides abroad.
